TERMS OF SERVICE LEADERBOOK.APP

1. Parties

These Terms of Service constitute a legally binding agreement between:

• Provider: Jan Bock, private person, Germany

• Service: Leaderbook.app

2. Definitions

• Service means the SaaS application Leaderbook.app including all websites and related functions.
• User means any individual using the Service.
• Account means a registered user profile.
• Free Plan means the no-cost version of the Service.
• Premium Features means additional paid functionality.
• Content means all data, notes, tasks, and information entered by Users.

3. Description of the Service

Leaderbook.app is a private productivity notebook for leaders and freelancers. The Service allows Users to capture notes, manage tasks, organize projects, and track personal progress. Basic usage is free. Additional functionality may require payment.

4. License to Use

The Provider grants Users a limited, non-exclusive, non-transferable, revocable license to access and use the Service according to these Terms. All intellectual property rights remain solely with the Provider.

5. Eligibility

• The Service is intended for adults.
• Users must be at least 18 years old or the age of majority in their country.
• Users must be legally capable of entering into contracts.

6. Accounts

Account creation is required to use the Service. Users are responsible for:

• Maintaining the security of login credentials
• Providing accurate registration information
• All activity occurring under their Account

The Provider may suspend or terminate Accounts that violate these Terms.

7. Free Plan Conditions

The Free Plan is subject to limitations. Current limits include:

• A maximum of 100 notes or tasks
• Feature cap of 100 items overall

The Provider reserves the right to change Free Plan limits at any time.

8. Paid Plans and Premium Features

Premium Features will soon be offered as a monthly subscription. Pricing, payment terms, and available functions are displayed inside the Service. Users agree that:

• Subscriptions may renew automatically
• Prices can be changed for future billing cycles
• Payments are processed through third-party payment processors

9. Free Trial

The Provider may offer free trials for Premium Features.

At the end of a trial:

• Users can cancel before any charges occur
• Continued use may convert into a paid subscription according to displayed conditions

10. Refund Policy

For paid subscriptions:

• No refunds are provided except where required by applicable mandatory law.

For the Free Plan:

• No refunds apply because no payment is made.

11. User Content

Users retain ownership of all Content they enter into the Service. Users grant the Provider the necessary rights to:

• Store
• process
• display
• transmit

Content solely for the purpose of operating the Service. The Provider is not responsible for the legality, accuracy, or quality of User Content.

12. Data Storage

User data may be stored on servers located in the United States, including US-East regions. The Provider may move data to other regions in the future. Users acknowledge that international data transfers can occur.

13. Acceptable Use

Users must NOT use the Service to:

• Perform illegal activities
• attempt unauthorized access
• disrupt or overload the Service
• distribute malware
• violate rights of others
• create fake or abusive Accounts

Any misuse may result in immediate termination.

14. Privacy Policy

Use of the Service is also governed by the Privacy Policy published on Leaderbook.app. The Privacy Policy forms part of this Agreement.

15. No Warranties

The Service is provided AS IS and AS AVAILABLE. The Provider makes no warranties or guarantees regarding:

• uptime
• error-free operation
• fitness for a specific purpose
• data accuracy
• permanent availability
• Free Plan usage includes absolutely no service level commitments.

16. Limitation of Liability

To the maximum extent permitted by law:

• The Provider is not liable for indirect, incidental, or consequential damages.
• The Provider is not liable for lost data, lost profits, or business interruption.
• For free Users, liability is excluded entirely.
• For paid Users, total liability is limited to the amount paid by that User in the last 12 months.

17. Termination by Provider

The Provider reserves full rights to:

• modify the Service
• suspend the Service
• discontinue the Service
• terminate any User Account

at any time, for any reason, without prior notice and without liability. The Provider may also terminate this Agreement entirely and stop offering Leaderbook.app to all Users.

18. Termination by Users

Users may cancel their Accounts at any time through the Service or by contacting info@leaderbook.app. After termination:

• Access to the Account can be removed
• User Content may be deleted after reasonable retention periods

19. Changes to Terms

The Provider may change these Terms of Service at any time. Updated terms are published on the Website. Continued use of the Service after changes constitutes acceptance of the new Terms.

20. Indemnification

Users agree to indemnify and hold harmless the Provider from any claims, damages, or expenses arising from:

• their misuse of the Service
• violation of these Terms
• violation of laws or third-party rights

21. Force Majeure

The Provider is not responsible for failures or delays caused by events beyond reasonable control including internet outages, hosting provider issues, or governmental actions.

22. Governing Law and Venue

This Agreement is governed exclusively by German law. Venue for all disputes is the competent courts in Germany. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

23. Export and Sanctions

Users confirm they do not access the Service from countries where such use is prohibited or restricted by sanctions.

24. Entire Agreement

These Terms of Service together with the Privacy Policy represent the entire agreement between Provider and Users.
